I-BUY.AI Terms of Service

These Terms of Service ("Terms") are an agreement between you and I-BUY.AI, a service owned by Phipps Holdings LLC, a New Jersey limited liability company ("I-BUY.AI," "we," "us" or "our"). They cover your use of the I-BUY.AI website, the I-BUY.AI email addresses (including hi@i-buy.ai and claim tracking addresses), and any related services (together, the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who provides the Service

I-BUY.AI provides the Service. Your agreement, and any claim related to the Service, is with us and not with any of our owners, members, managers, employees or contractors individually.

2. Private beta

The Service is in private beta. It is offered free of charge for now, may change often, may contain errors, and may be unavailable at times. We may approve, decline, pause or end access to the beta at our discretion.

We may add, change or remove features at any time, including during the beta. For example, we may let you share your account with people in your household, and we may set limits on how much you can use the Service, such as how many products or claims you can add in a period. If you share your account, everyone you share it with can see and add to its receipts, products and claims, so share it only with people you trust. If we ever offer paid plans, we will tell you the price and terms first, and we will never charge you without your agreement.

3. Eligibility and your account

  • The Service is for people in the United States only. You must live in the United States to create an account or use the Service. Anyone outside the United States is not permitted to use it, and we may close any account that belongs to someone outside the United States.
  • You must be at least 18 years old and able to form a binding contract.
  • You sign in with a Google account, or with your email address and a password. You are responsible for keeping that account, your password and your email inbox secure, and for activity that happens under your I-BUY.AI account.
  • Only emails sent from your own verified address, or from the verified address of someone you share your account with, are accepted. Please do not forward receipts or messages from other people's accounts.

4. What I-BUY.AI does, and what it does not do

I-BUY.AI reads the receipts and emails you send us, organizes your purchases, estimates return windows and warranty coverage, and drafts messages you can choose to send to companies.

Please understand the following:

  • Information only. Coverage dates, warranty terms, return windows, Warranty Scores and other details are estimates based on documents and sources available to us. They may be incomplete, out of date or wrong. Always confirm terms with the retailer or manufacturer before relying on them, especially near a deadline.
  • AI summaries are not the official terms. Many of the warranty and return policies in the Service are summarized by artificial intelligence from public sources. Summaries can leave things out or get them wrong, so do not rely on them as the exact wording of any warranty or policy. The manufacturer's or retailer's own documents always control.
  • Safety recalls are a beta feature. Recall alerts compare your products with public recall data, such as from the U.S. Consumer Product Safety Commission. They are part of a beta service, and we make no claim that they are accurate or complete. We can miss a recall, flag the wrong product, or show out-of-date information. Recall alerts are not a substitute for official recall notices. Always follow the instructions from the manufacturer or the government agency.
  • Not legal, financial or professional advice. Nothing in the Service is legal advice or a guarantee of any outcome.
  • You are in control of every claim. I-BUY.AI does not contact companies on your behalf and is not your agent. Claim emails are drafts. You decide whether to send them, and you are responsible for reviewing them for accuracy before you do.
  • No affiliation. I-BUY.AI is not affiliated with, endorsed by, or acting for any retailer, manufacturer or brand shown in the Service. Brand and product names belong to their owners.
  • Deadlines are yours. Reminders are a courtesy. You remain responsible for meeting any return, warranty or claim deadline.

5. Automated and AI features

The Service uses automated tools, including artificial intelligence, to read documents, match products, estimate coverage and draft messages. These tools can make mistakes, and nothing they produce should be trusted word for word. Review anything the Service produces before you rely on it or send it.

6. Your content

"Your content" means receipts, emails, photos, descriptions and other material you send to or create in the Service.

  • You keep ownership of your content.
  • You give us a non-exclusive, worldwide, royalty-free license to store, copy, process, analyze and display your content to provide, maintain, secure, develop and improve the Service, as described in our Privacy Policy.
  • You confirm that you have the right to send us your content, and that it does not violate anyone else's rights or the law.

How your experience helps others. I-BUY.AI gets better the more it learns from real purchases and real claims. We may use information from your content and your activity in the Service, such as the products you own, what went wrong, what you asked a company for, what they asked of you, how long it took and how it turned out, to develop and improve the Service for you and for other users. This includes improving how I-BUY.AI reads receipts, estimates coverage, recommends options and drafts messages, and building tips like "this brand usually asks for a photo of the label."

When information learned from your content is shown to other users or shared outside I-BUY.AI, it is de-identified or combined with other users' information so that it does not identify you. We may keep and use de-identified or combined information after your account ends.

Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.

7. Acceptable use

You agree not to:

  • use the Service for anything unlawful, fraudulent or misleading, including making false warranty or return claims;
  • send content that is not yours to share, or that contains malware;
  • try to access other users' data or any part of the Service you are not authorized to use;
  • interfere with, overload, scrape or reverse engineer the Service; or
  • resell or provide the Service to others.

We may suspend or close accounts that break these rules.

8. Third-party services

The Service relies on services from other companies, such as Google for sign-in and cloud providers for hosting, email and data processing. Your use of those services is also subject to their terms. We are not responsible for third-party services or for websites and companies you contact using information from I-BUY.AI.

9. Changes to the Service and ending your account

We may change, suspend or discontinue any part of the Service at any time. You may stop using the Service and delete your account at any time from the Account page. We may suspend or end your access if you break these Terms, if required by law, or if we end the beta. Sections 4, 6 (de-identified and combined information, and feedback), 10, 11, 12 and 13 continue after your account ends.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY COVERAGE INFORMATION, WARRANTY OR RETURN POLICY SUMMARY, RECALL ALERT OR DRAFT MESSAGE IS ACCURATE, COMPLETE OR WILL RESULT IN A SUCCESSFUL CLAIM.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, I-BUY.AI AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, REFUNDS, REPLACEMENTS, WARRANTY RIGHTS OR MISSED DEADLINES, ARISING FROM OR RELATED TO THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50).

Some jurisdictions do not allow certain disclaimers or limits, so some of the above may not apply to you.

12. Indemnity

To the extent permitted by law, you agree to defend and hold harmless I-BUY.AI and its owners, members, managers, employees and contractors from claims, losses and expenses (including reasonable attorneys' fees) arising from your content, your misuse of the Service, or your violation of these Terms or the law.

13. Disputes

  • Talk to us first. If you have a concern, email help@i-buy.ai. We will try to resolve it informally within 30 days.
  • Governing law. These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules.
  • Where disputes are heard. Any dispute that is not resolved informally will be brought only in the state or federal courts located in New Jersey, and you and we consent to those courts. Either party may bring an eligible individual claim in small claims court instead.
  • Time limit. To the extent permitted by law, any claim related to the Service must be brought within one year after it arises.

14. Changes to these Terms

We may update these Terms. If we make a material change, we will notify you by email or in the Service before it takes effect. Continuing to use the Service after the change means you accept the updated Terms.

15. General

These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms; we may transfer them in connection with a merger, sale or reorganization.
